Type of Document: Mortgage and Trust Deed

TYPES OF FORECLOSURE:

Non-judicial: The trust deed with a power of sale clause is used most often and can be sold without the court involvement.

Judicial: This method is used when a mortgage has to be foreclosed on.

Deficiency Judgment: Not available to lender if a trustee sale was held; available with a court sale

Redemption: Allowed for one year after the foreclosure is complete

Oddities: If the borrower has been in foreclosure two times before the current action, the lender may refuse the back payments and continue the foreclosure.

Other wise the borrower may make up back payments anytime prior to the sale.
