TYPES OF FORECLOSURE:

Non judicial foreclosure is used when the loan document contains a power of sale clause. The process takes approximately 120 days.

Judicial foreclosure is used when the lender wants to pursue a deficiency judgment or the loan document does not contain the power of sale clause.

Deficiency: No deficiency is allowed when sold by non judicial foreclosure. A deficiency is allowed through judicial foreclosure.

Redemption: If the sale was non judicial, no redemption is allowed. If judicial, the borrower has 180 days to redeem.
